Texas Bans Cartoon Images and Celebs in Vape Advertising

A new law taking effect in Texas this January prohibits e-cigarette marketing that appeals to minors through cartoons, celebrities, or food/candy motifs. This aims to reduce teen vaping rates in the state.

Called the Protecting Children from Electronic Cigarette Advertising Act, the law makes it illegal to advertise, promote, or sell vaping products to underage users in certain ways.

Banned Vape Marketing Tactics in Texas


The law bans vape marketing that:

  • Uses cartoons or fictional characters appealing primarily to minors
  • Imitates packaging/trademarks aimed at youth
  • Includes symbols commonly used to market to minors
  • Depicts celebrity images
  • Resembles food items like candy or juice

Even where vapes are displayed in stores will be restricted under the law to limit youth exposure.


Curbing Teen Appeal While Allowing Adult Access


Per a marketing professor, while vape companies may push back on advertising limits, most will comply to retain access to Texas' large market. But some youth-oriented marketing tactics will likely continue through loopholes.


Effective enforcement with penalties will help deter prohibited ads. But the law signifies Texas' seriousness about curbing underage vape usage through restrictions on how products are promoted.


Nationwide surveys also suggest teen vaping rates are beginning to decline. In 2022, 14% of high school students reported vaping in the past month, down from 17% in 2020. While still too high, new regulations may be having an impact.

However, anti-vaping advocates argue stricter measures are still needed to prevent youth addiction. But others warn going too far risks harming adult smokers seeking reduced-risk alternatives.
